Offenders may be fined and serve up to three years in prison. Once reported, platforms are required to remove that content within 48 hours, subject to enforcement by the Federal Trade Commission (FTC).
State-Level Laws
- Maryland: More narrowly defined its revenge porn statutes but broadened the construction to encompass AI-generated fake videos. Penalties may include fines of up to $5,000 and two years in prison, plus the ability for victims to sue.
- New York: Includes deepfake porn in the revenge porn statutes as long as the attorney can demonstrate intent to harm.
- Texas (SB 20): Effective September 1, 2025, outlaws possession or promotion of obscene AI-generated images or videos containing children. Penalties may include fines and imprisonment for up to 2 years.
- California & Virginia: Approved legal restrictions on sexually explicit deepfakes, at least in terms of revenge porn and election interference.
How Parents Can Protect Children from Undress AI
